This Privacy Policy is prepared to inform you (“you” or the “data subject”) of the purposes and details in relation to the collection, use, and disclosure of your Personal Data by the “Company” or “we” as the Data Controller of your Personal Data, as well as your rights as the data subject according to the Personal Data Protection Act B.E. 2562 (2019) (the “PDPA”) and the subordinate regulations and notifications issued thereunder.

1. Definition

The following terms used in this Privacy Notice shall have the meaning as follows:

Personal Data” means any information relating to an individual person, which enables the identification of such person, whether directly or indirectly, but not including the information of the deceased persons in particular. The Personal Data shall include the Sensitive Data;

The company” means Yokohama Asia Co., Ltd. And the Yokohama Rubber Group Companies in ASEAN including Yokohama Tire Manufacturing (Thailand) Co., Ltd., Yokohama Mold (Thailand) Co., Ltd., Yokohama Rubber (Thailand) Co., Ltd., Y.T. Rubber Co., Ltd., Yokohama Tire Sales (Thailand) Co., Ltd., Yokohama Tire Sales Philippines Inc., Yokohama Tyre Sales Vietnam Co., Ltd., Yokohama Tyre Sales Malaysia Sdn. Bhd., Yokohama Tyre Vietnam Inc., Yokohama Tire Philippines, Inc., Yokohama Industrial Products Asia-Pacific Ptr. Ltd., Yokohama Rubber Singapore Pte., Ltd., and PT. Yokohama Industrial Products Manufacturing Indonesia

Sensitive Data” means the Personal Data pertaining to race, ethnic origin, political opinions, belief in cults, religion or philosophy, sexual behavior, criminal records, health data, disability, trade union information, genetic data, biometric data, or of any data which may affect the data subject in the same manner, as prescribed by the Personal Data Protection Committee; and

Data Controller” means an individual or a juristic person having the power and duties to make decisions regarding the collection, use, or disclosure of the Personal Data.

2. Purposes of the Collection for Use or Disclosure of your Personal Data

We will collect your Personal Data for the use or disclosure to the extent as necessary to accomplish the purposes specified below and in accordance with the lawful basis as provided by the PDPA. In the event of collection of your Personal Data without lawful basis, we will proceed to obtain prior consent from you as required by the PDPA.

  • the verification of your identity when contacting the Company;
  • the necessity for performance of a contract to which you are a party, or in order to take steps at your request prior to entering into a contract;
  • the future communication with you for various purposes including but not limited to offering products and services, conducting marketing activities, etc.;
  • the necessity for the overall business operation of the Company including but not limited to improving our business operation, products and services, etc.;
  • the necessity for the Company’s legitimate interests, any other persons or juristic persons other than the Data Controller including but not limited to fraud detection, security check, etc.;
  • the arrangement of welfare and other benefits to you in the case that you are the Company’s employee e.g. for provision of insurance, benefits, etc.;
  • the necessity for compliance with the laws which we are required to comply with including but not limited to taxation law, labour protection law, social security law, etc.;
  • the prevention or suppression of a danger to your life, body or health in case of emergency situation; and
  • the necessity for establishment, compliance, exercise and defense of the Company’s legal claims.

In case the Personal Data which we will process for the purposes relates to the compliance with the laws or contracts or is necessary for entering into a contract with you, whereby, such Personal Data is necessary for the achievement of such purposes, if you do not provide such Personal Data to us, there may be a legal impact or we may not be able to perform its legal obligations under the contract entered into with you or may not be able to enter into the contract with you.

In case that we intend to use or disclose your Personal Data for a new purpose which is not specified above, we will notify you of the new purpose. If your consent is required for the use or disclosure of your Personal Data for the new purpose under the PDPA, we will proceed to obtain your consent prior to the use or disclosure of your Personal Data for such new purpose.

3. Personal Data to be Collected

We will collect your Personal Data as follows:

  • your Personal Data including but not limited to your name, last name, information in Thai ID card, passport and house registration book and other official documents, nationality, date of birth, gender, age, occupation, marital status, photo, telephone number, address, e-mail address, bank account number, employment information, education information, work experience, family members including your children, emergency contact, log files, internet cookies, IP address, website browsing history and other similar technologies, recording from security camera, record of your contact and communication with the Company including voice record, email correspondence, etc.;
  • your Sensitive Data including but not limited to your religion, criminal records, health related data and health records, biometric data, etc.; and
  • any other Personal Data that you have consented to provide to us and that we lawfully received from a third party(ies) according to the PDPA.

We will collect your Personal Data via the following methods:

  • your Personal Data which you directly provide to us. You may directly provide your Personal Data to us when you contact us, make enquiries, complete forms either by online or by document, request for services or join activities, request for information, receive marketing communications, or provide comments or feedback to us, etc.;
  • your Personal Data which we automatically collect from you. We may automatically collect some technical information, in relation to your devices, activities and visiting patterns and website browsing history, which are your Personal Data, by using cookies and other similar technologies; and
  • your Personal Data which we received from third parties. We may, from time to time, receive your Personal Data from third parties, such as agents, service providers, job recruiters, government organizations, your personnel and contact person, etc.

4. Retention Period

We will retain your Personal Data for as long as is necessary to fulfill the purposes for which it was collected. We may retain your Personal Data for a longer period if it is permitted or required by the laws, or the Personal Data may be the subject of a legal claim, or may otherwise be relevant for future litigation.

5. Categories of Persons or Entities to whom your Collected Personal Data may be Disclosed

In order to fulfil the purposes for which the Personal Data is collected, we may disclose or transfer your Personal Data as deemed relevant and necessary to others, such as our employees, directors, our affiliated and group companies including their personnel, government authorities, banks, legal counsels, consultants, agents, insurance companies, contractors, payroll service providers and other service providers, as well as the persons or entities assigned by us to operate in relation to the collection, use or disclosure of your Personal Data, either in Thailand or in overseas countries.

The disclosure and transfer of your Personal Data to third parties, either in Thailand or in overseas countries, shall be in accordance with the PDPA.

6. Rights of Data Subjects

Subject to the PDPA, you have the rights to proceed as follows:

  • right to withdraw your consent given to us at any time; however, the withdrawal of consent will not affect the collection, use, or disclosure of the Personal Data that you have already given the consent legally;
  • right to request to access to and obtain copy of the Personal Data related to you, which is under our responsibility, or to request the disclosure of the acquisition of the Personal Data obtained without your consent;
  • right to receive the Personal Data concerning you in the format which is readable or commonly used by ways of automatic tools or equipment, and can be used or disclosed by automated means. You are also entitled to:
    • request us to send or transfer the Personal Data to other Data Controllers; and
    • request to directly obtain the Personal Data that we have sent or transferred to other Data Controllers;
  • right to object the collection, use, or disclosure of the Personal Data concerning you, at any time under certain circumstances;
  • right to request us to erase or destroy the Personal Data, or anonymize the Personal Data to become the anonymous data which cannot identify the data subject under certain circumstances;
  • right to request us to restrict the use of the Personal Data under certain circumstances;
  • right to request us to keep the Personal Data relating to you accurate, up-to-date, complete, and not misleading; and
  • right to file a complaint in the event that we, including our employees or contractors, violate or do not comply with the law on Personal Data protection.

You may contact our responsible person through the channels as stated in item 6 to inquire about your rights and to exercise your rights subject to the PDPA. Upon our receipt of your request to exercise your rights, we will consider your request and inform the result of our consideration within 30 days since the receipt of such request.

7. Changes to this Privacy Notice

We reserve the right to amend the terms of this Privacy Notice at our discretion without informing you in advance to be in accordance with the PDPA and the subordinate regulations and notifications issued thereunder.
